for concluding a distance sales agreement

This document constitutes an official public offer of
LLC “MEDATHLETIC”, EDRPOU code 45114921, registered address: Kyiv, Viyskovyi proizd 1/8 (hereinafter — the “Seller”),
to conclude a distance sales agreement via the website https://medathletic.in.ua (hereinafter — the “Website”) with any legally capable person (hereinafter — the “Buyer”).
This Offer is public in accordance with Articles 633, 641, 642 of the Civil Code of Ukraine.
1. MOMENT OF CONCLUSION OF THE AGREEMENT
1.1. The Agreement is deemed concluded upon:
• placing an Order on the Website by the Buyer;
• confirmation of the Order by the Seller;
• and/or payment.
1.2. The Seller reserves the right to refuse confirmation of the Order in case of:
• product unavailability;
• technical error in price or description;
• suspected fraudulent activity;
• violation of previous agreements by the Buyer.
2. SUBJECT OF THE AGREEMENT
2.1. The Seller undertakes to transfer to the Buyer ownership of sports goods, medical products, rehabilitation equipment, kinesiology tapes, orthoses, braces, and other goods presented on the Website.
2.2. Information published on the Website is for informational purposes only and does not constitute medical advice.
2.3. The Buyer is solely responsible for the selection of goods.
3. PRICE AND ERRORS
3.1. The price of the goods is determined at the moment of placing the Order.
3.2. In case of a technical error (system failure, incorrect price, content error), the Seller has the right to:
• cancel the Order;
• refund the paid amount;
• offer the current valid price.
3.3. Cancellation due to a technical error shall not be considered a breach of obligations.
4. DELIVERY AND TRANSFER OF RISK
4.1. Delivery is carried out by courier and postal services within the territory of Ukraine.
4.2. The risk of accidental loss or damage to the goods transfers to the Buyer from the moment the goods are handed over to the carrier.
4.3. A signature on the delivery note confirms the absence of visible damage at the time of receipt.
4.4. Claims regarding transportation damage are accepted only upon presentation of a carrier’s official report.
5. RETURN OF GOODS
5.1. Returns are carried out in accordance with the Law of Ukraine “On Consumer Protection”.
5.2. Goods of proper quality may be returned within 14 days provided that:
• they show no signs of use;
• original packaging is preserved;
• the complete set is maintained;
• a proof of purchase is provided.
5.3. Delivery costs for returning goods of proper quality are borne by the Buyer.
5.4. In accordance with Cabinet of Ministers Resolution No. 172, the following are non-returnable:
• medical goods;
• medical devices;
• personal hygiene products;
• kinesiology tapes and other goods if the packaging integrity is broken.
5.5. In case of manufacturing defects, the goods are subject to exchange or refund.
6. LIMITATION OF LIABILITY
6.1. The Seller’s liability is limited to the amount actually paid for the respective goods.
6.2. The Seller is not liable for:
• improper use of goods;
• allergic reactions or individual sensitivity;
• consequences of use without medical consultation;
• indirect or consequential damages;
• loss of profit;
• technical failures of the Website;
• actions of third parties.
7. FORCE MAJEURE
7.1. The Parties shall be released from liability in case of force majeure circumstances, including martial law, power outages, actions of state authorities, strikes, disasters.
8. PERSONAL DATA
8.1. By placing an Order, the Buyer consents to the processing of personal data in accordance with the Law of Ukraine “On Personal Data Protection”.
9. AMENDMENTS TO THE OFFER
9.1. The Seller has the right to amend this Offer without prior notice.
9.2. The version effective at the time of placing the Order shall apply to each Order.
